General Terms and Conditions / Rental Terms “Lakeside Oasis”

These General Terms and Conditions apply to the rental of the holiday apartment “Lakeside Oasis” in Lindau-Zech and to all related services between the landlady and the guest/tenant.

1. Arrival and Departure

Check-in is possible from 3:00 p.m. on the day of arrival. Check-out must take place by 10:00 a.m. on the day of departure. Other arrival and departure times may be arranged individually by prior agreement, provided this is organizationally possible. Arrival usually takes place independently via a personalized access code. The access code will be sent to the guest in good time before arrival. The code must be treated confidentially and must not be passed on to unauthorized third parties. No partial refund will generally be granted in the event of late arrival or early departure.

2. Special Requests and Additional

Agreements Special requests and additional agreements are generally possible, but require prior written confirmation from the landlady. This applies in particular to special arrival times, additional services, charging an electric vehicle or any other individual arrangements.

3. Booking and Payment

The booking becomes binding once it has been confirmed by the landlady or via the booking system used. The agreed rental price is stated in the respective booking confirmation. It includes the use of the holiday apartment for the booked period as well as the services included in the offer. The full rental amount is due no later than 30 days before arrival, unless a different payment arrangement has been agreed in writing. For short-notice bookings made within 30 days before arrival, the total amount is due immediately. If agreed payment deadlines are not met, the landlady is entitled to withdraw from the contract and rent the accommodation to another guest. Additional costs for water, regular electricity consumption, waste disposal and the private parking spaces are not charged separately, unless otherwise agreed. Charging an electric vehicle is possible by prior arrangement. The electricity costs incurred for this will be calculated separately after the stay and communicated to the guest in writing.

4. Cancellation by the Guest

The guest may cancel the booking free of charge up to 30 days before arrival. In the event of cancellation within 30 days before arrival, the full booking amount will be due or any amount already paid will be retained. The decisive factor is the time at which the written cancellation is received by the landlady or via the booking system. A replacement person who enters into the contract under the existing conditions may be named by prior agreement. The landlady must be informed of this in writing.

5. Duties of the Guest

The guest undertakes to treat the holiday apartment, inventory, furnishings and outdoor areas such as the terrace, balcony, parking spaces and garage with care. Any damage, defects or malfunctions occurring during the stay must be reported to the landlady immediately so that they can be resolved as quickly as possible. Any defects or damage already noticed upon arrival must also be reported immediately. If no report is made, it may be assumed that the accommodation was handed over in proper condition upon arrival. The guest undertakes to do everything reasonable to keep any possible damage to a minimum. The holiday apartment may only be used by the number of persons stated in the booking. Overoccupancy or passing the accommodation on to third parties is not permitted without the prior consent of the landlady. On the day of departure, personal belongings must be removed and used dishes must be left clean or placed in the dishwasher. The accommodation must be left in a tidy condition.

6. Use of the Accommodation

The holiday apartment is rented exclusively for temporary use as holiday accommodation. The guest undertakes to comply with the house rules as well as generally accepted duties of consideration. In particular, quiet hours must be observed and neighbors must not be disturbed. Smoking is not permitted inside the accommodation. In the event of a violation of the smoking ban, additional cleaning or damage removal costs may be charged. Pets are only permitted with prior express approval.

7. Parking Spaces, Garage and Electric Vehicle Charging

The accommodation includes two private, free parking spaces. Use is at the guest’s own risk. A lockable garage may be used for e-bikes. Charging an electric vehicle is also possible by prior arrangement. The electricity costs incurred for charging will be calculated according to consumption and communicated to the guest in writing after the stay. Billing is based on the actual or verifiably measured consumption. The guest is liable within the scope of the statutory provisions for any damage caused by improper use of sockets, charging equipment, cables or vehicles.

8. Data Protection

The guest’s personal data will be processed exclusively for the purposes of booking processing, communication, payment processing and legally required documentation. All personal data will be treated confidentially and will not be passed on to unauthorized third parties without a legal basis. Further information can be found in the privacy policy on the website.

9. Liability

The description of the accommodation has been prepared to the best of our knowledge. Minor deviations from images, descriptions or equipment details are reserved, provided they do not significantly affect the overall character and usability of the accommodation. The landlady is not liable for impairments caused by force majeure, official orders, temporary power, water or internet outages, severe weather, construction work, traffic disruptions or other unforeseeable events for which the landlady is not responsible. However, the landlady will make every effort to provide quick and solution-oriented assistance in the event of any problems. Arrival and departure are the guest’s own responsibility. No liability is accepted for the guest’s personal belongings, unless the landlady has acted intentionally or with gross negligence. The guest is liable within the statutory scope for any damage caused by the guest, fellow travelers or visitors.

10. Final Provisions

German law shall apply. Should individual provisions of these rental terms be or become invalid, the validity of the remaining provisions shall remain unaffected. Changes or additions to these terms must be made in text form. The place of jurisdiction and place of performance shall be determined in accordance with the statutory provisions.
